AVB granted privacy injunction

Privacy claims succeeds but harassment claim fails

Following a contested trial, judgment has been given by Tugendhat J in AVB v TDD.

AVB is a retired male solicitor and TDD a female prostitute.  The dispute arose from the disclosure of AVB’s private and confidential information by TDD to AVB’s work colleagues and family.

AVB brought claims in harassment, misuse of private information, breach of confidence and breach of contract. TDD counterclaimed that AVB had harassed her.

AVB succeeded in his claims for misuse of private information and breach of confidence but failed in those for harassment and breach of contract.  He was granted an injunction but not awarded damages.  TDD’s claim in harassment succeeded but she was granted neither an injunction nor damages.
