Freedom of Expression - checking the balances

Mr Justice Gray has delivered this year’s Margaret Howard Memorial Lecture on Literature and the Law: Freedom of Expression – checking the balances.

 

Gray J discusses the most recent authorities on defamation, prior restraint, misuse of personal information and contempt of court. The Judge concludes that, “I believe – I hope without being complacent- that the common law, with the stimulus of the European Convention and sometimes with statutory assistance, has on the whole so far succeeded in making the necessary adjustments to strike an appropriate balance between freedom of expression and other competing rights and interests.
