Jessie Wallace fails in injunction bid

Judge allows News of the World to print former boyfriend’s allegations

Eastenders’ star Jessie Wallace has failed in an attempt to prevent allegations about her private life becoming public.

On Saturday 7 May, Ms Wallace sought an injunction to prevent the News of the World from publishing information about her private life provided by her former boyfriend, the father of her daughter. Ms Wallace claimed that publication of the information would be in breach of her privacy and in breach of a contract with her signed by the former boyfriend.

After a two-hour telephone hearing on Saturday evening, Mr Justice Andrew Smith refused the injunction, in part because Ms Wallace had actively sought publicity.  As she had promoted positive aspects of her private life, she could not now complain if negative aspects were also brought to the public’s attention. Furthermore contractual considerations could sometimes be overridden by Article 10 of the ECHR.

5RB‘s James Price QC (instructed by Schillings) acted for Ms Wallace.
