Administrative Law
Since the Human Rights Act 1998 many cases involving freedom of expression have been decided as judicial reviews of decisions of public authorities. Many members of chambers have extensive experience in the Administrative court which includes judicial review.
Cases include R v Health Secretary ex parte Associated Newspapers & Others [2001] 1 WLR 292 where combined media applicants sucessfully challenged the decision of Secretary of State for Health to hold inquiry into the Shipman deaths in private and R (Persey) v Secretary of State for Environment Food & Rural Affairs [2003] QB 794 where the media again challenged access to information about the Foot and Mouth inquiry, under Art 10 ECHR.
Members of 5RB are also involved in judicial reviews of decisions of the Press Complaints Commission and the other media regulators.
