Passing off
Passing off litigation is another method of protecting signs which can distinguish the goods and services of one trader from that of another. Members of 5RB have been involved in a number of passing off actions, such as Radio Taxicabs (London) Ltd v Owner Drivers Radio Taxi Services Ltd, and are able to advise upon and act in disputes relating to passing off, trademark infringement and the ownership of trademarks. Increasingly, passing off is being used to develop personality rights particularly in the context of advertising - see for example, Irvine v Talksport.
