Public Law
There are a number of areas of media law which fall into the public law sphere. Ordinarily, a legal challenge to a decision of a regulatory body (e.g. Ofcom, Advertising Standards Authority or the Press Complaints Commission) has to be made by way of judicial review. As with any area touching upon human rights, judicial review in relation to decisions involving privacy and freedom of expression raise special considerations and increased scrutiny by the Courts.
In addition to judicial review of decisions of administrative bodies in the media field, some members of 5RB have a wider public law practice.
