Guardian overturns disclosure ruling

Appeal court judgment breaks new ground in the application of open justice

The Guardian today won its long running claim to obtain access to US Government documents referred to in an English extradition claim.

In a judgment which has potentially wide reaching implications, the Court of Appeal ruled that in future, where any case raises issues of public interest, the default position should be that the media should be entitled to secure access to documents referred to in open court.

5RB‘s Adam Wolanski (instructed by Reynolds Porter Chamberlain) was junior counsel for the Guardian.
