High Court grants interim injunction

Criminal investigation and interview engage Claimant's Article 8 rights

Mr Justice Nicol has today handed down judgment in the case of ERY v Associated Newspapers Limited, granting an interim injunction to the Claimant preventing the publication of information regarding a police investigation into the Claimant. The Court concluded that the Defendant’s rights under Article 10 were not likely to prevail over the Claimant’s rights under Article 8 at trial so far as publication of information that the Claimant, personally, was being investigated by the police, and therefore granted the injunction. The judgment has been published in anonymised form in order that a substantial amount of the facts and Nicol J’s reasoning may be published.
