The Court of Appeal will today hear the appeal in the data protection claim, Vince v Associated Newspapers Limited.
The appeal is against the order of Mr Justice Swift striking out the claim (see the judgment at [2025] EWHC 1411 (KB)). The Court will hear argument on the scope of the rule in Henderson v Henderson, the proper approach to the principle that personal data be processed “fairly” in Article 5(1)(a) of the UK GDPR, and the relevance of common law principles developed, principally, in the law of defamation.
