5RB‘s Godwin Busuttil has written a new article entitled “The law governing the reporting of financial remedy proceedings in the family courts: where are we?”. It is based on a talk he gave to Harbottle & Lewis‘s media and family teams on 4 October 2022.
The article considers the Report by Sir Andrew MacFarlane, the President of the Family Division, “Confidence and Confidentiality: Transparency in the Family Courts”, published in October 2021, and a series of six judgments of Mr Justice Mostyn handed down since then in which the judge has called into question the validity of the account of the legal principles that informed the President’s recommendations.
