Mediation is one of the main forms of alternative dispute resolution (ADR) used in England and Wales. It can be an efficient way of resolving even the most acrimonious disputes. Unlike litigation, which seeks to attribute blame by determining who is in the wrong and who is in the right, mediation focuses on the future and on identifying possible accommodations that all the parties can accept and from which they can move on. Media and communications claims are often paused or ‘stayed’ to allow for a mediation to take place following the first case and costs management conference.
All of our members are able to advise and represent clients at mediations and arbitrations in the media and communications field.
The potential success of a mediation rests not merely on a willingness to mediate, but on the appointment of a skilled mediator who can command the confidence of the disputing parties and guide them towards an acceptable solution. In the media and communications field, this means not only accreditation and experience in mediation but also expertise in this very specialised area of law and the various forms of factual dispute that arise within it.

Several of our barristers – Adrienne Page KC, Christina Michalos KC and Kate Wilson – are members of the Independent Press Standards Organisation (IPSO) Arbitrator Panel. IPSO is the regulator of most of the mainstream digital and print news industry in the UK. IPSO has worked with the Centre for Effective Dispute Resolution (CEDR) to produce a list of barristers for its Arbitrator Panel. Each of these barristers has been approved as having the necessary experience and expertise in media law to arbitrate and rule upon disputes entering the IPSO scheme.
Our fees for mediation and arbitration work will reflect the value and complexity of the dispute and the seniority of the mediator/arbitrator. They will always be competitive. Our clerks will be happy to discuss fees and any other enquiries you have. 5RB also has rooms and other facilities available for meetings.
Senior members of chambers accept instructions to conduct Early Neutral Evaluations (see CPR 3.1(2)(p)), another form of ADR that is particularly suited to, for example, issues of meaning.
