Data protection and information law is a rapidly developing area following the introduction of the Data Protection Act 2018 and the UK General Data Protection Regulation (GDPR). 5RB barristers are highly experienced in advising data subjects in respect of their rights under the GDPR, including subject access, right to be forgotten and the right to rectify inaccurate or incomplete personal data.
We also support data controllers, including public authorities and private organisations, in respect of their responsibilities under the GDPR. This includes advising on privacy and data protection policies; how to handle subject access and related requests; and the applicability and scope of any exemptions. Our barristers can also advise clients on the ‘right to be forgotten’ – whether in relation to search engines or other publishers.
Data protection and information law issues often touch on other 5RB specialisms, such as misuse of private information, breach of confidence, and defamation. These are core areas of practice for our members, who are experienced and well placed to advise in respect of the benefits of bringing or defending claims concerning several categories of damages or ‘heads of loss’.
5RB barristers can also advise in respect of Freedom of Information Act 2000 requests. The Act grants wide-ranging access to non-personal information held by public authorities, including the Government, subject to any applicable exemptions.
