5RB barristers can support clients with standalone intellectual property claims, as well as issues arising from pre-publication reviews of works that refer to third-party source material.

Our core areas of practice include copyright, passing off, contractual disputes and advertising, performers’ rights and moral rights. We also undertake work relating to trademark use (outside the sphere of comparative advertising), database rights, design rights, and telecommunications and broadcasting regulation.

Our members draw on their broader media law expertise to provide focused and commercially sensible advice, and that includes services operating outside the media context.

Significant intellectual property cases involving 5RB members include:

  • Duchess of Sussex v Associated Newspapers Ltd [2021] EWHC 273 (Ch): A claim brought by the Duchess of Sussex concerning the publication in the Mail on Sunday and MailOnline of a letter she had sent to her father after her wedding.
  • R (on the application of Drain) v Birmingham Crown Court & Ors [2018] EWHC 1255 (Admin): A judicial review which sought to quash a forfeiture order made under s.97 of the Trade Marks Act 1994. The goods forfeited goods comprised plaques featuring the images and trademarks of various classic cars.
