The Duchess of Sussex wins her privacy and copyright claim

The Duchess of Sussex has won her privacy and copyright claim against The Mail on Sunday after Lord Justice Warby gave summary judgment in her favour on liability on her claim for misuse of private information and on the issues of subsistence and infringement in her copyright claim.

In a judgment on Thursday, Lord Justice Warby ruled that the publication of the Duchess’s letter to her father by the Mail on Sunday was “manifestly excessive and hence unlawful” and that “There is no prospect that a different judgment would be reached after a trial”.

A link to the full Judgment can be found here. A case report will follow shortly.

A further hearing is scheduled for 2 March to deal with all consequential matters.

Justin Rushbrooke QC and Jane Phillips were acting for the Duchess.
Alexandra Marzec and Gervase de Wilde were acting for the Mail on Sunday.
