New article on defamation law in Gibraltar

In a small jurisdiction with a tightly knit community like Gibraltar, where news travels fast and reputations matter, defamation law plays a critical role. With a vibrant mix of individuals and organisations—many of them high-profile—the territory’s legal system must strike a careful balance between the constitutional rights of freedom of expression and protection of reputation.

In a newly co-authored article, Julian Santos of 5RB and Nicholas Borge, Director of Ramparts, take a closer look at Gibraltar’s unique defamation regime. The piece is an introduction to defamation law in Gibraltar, spotlighting key differences from the law of England & Wales, particularly in the light of the Defamation Act 2013, such as: the absence of the “serious harm” test, a six-year limitation period, and the continuing right to a jury trial in defamation cases.
