Supreme Court to hear ZXC v Bloomberg LP privacy appeal

The two-day appeal in ZXC v Bloomberg LP began today in the Supreme Court. The appeal will consider whether, and to what extent, a person who has not been charged with an offence can have a reasonable expectation of privacy in relation to information that relates to a criminal investigation into his activities.

ZXC brought a successful claim against Bloomberg for misuse of private information in respect of an article which included information taken from a confidential Letter of Request sent by a UK Legal Enforcement Body to a foreign state. The article referred to the information requested and the matters in respect of which ZXC was being investigated. Bloomberg’s appeal against that judgment was dismissed by the Court of Appeal in May 2020.

Bloomberg’s appeal is being heard in the Supreme Court on 30 November and 1 December 2021. The hearing will be streamed live here.
