Family Division – Reporting Restriction Orders – Applications in High Court – Notifying Respondents – Without Notice Orders – s.12 Human Rights Act 1998

Practice Note issued by the President of the Family Division with the concurrence and approval of the Lord Chancellor.

Practice on applications for injunctions to restrain publication.

The Note sets out requirements in relation to (1) the Application Notice and evidence in support; (2) service of the Application Notice via the Press Association CopyDirect Service; (3) the hearing; (4) scope of any order; (5) service of orders. It also sets out a model order and an example of an explanatory note.

This – together with the Practice Direction issued on the same day – now forms the basis of the procedure to be adopted in seeking reporting restriction orders in the Family Division. The Practice Note contains the contact details of the PA CopyDirect service.
