Wellers win MailOnline photos appeal

On 20 November 2015 the Court of Appeal handed down judgment in Weller & Ors v Associated Newspapers Limited. The publishers of the MailOnline website had appealed against the judgment of Dingemans J dated 16 April 2014 awarding Paul Weller’s children a total of £10,000 in damages for misuse of private information. The claim related to photographs taken of them by a paparazzo while they were on a family day out with their father in California. Dingemans J had also found that Associated had breached the Data Protection Act in publishing the photographs.

The Court of Appeal dismissed Associated’s three grounds of appeal in a 23-page judgment given by Lord Dyson MR (with whom Tomlinson and Bean LJJ agreed). 5RB‘s David Sherborne and Julian Santos, instructed by Clintons, acted for the the Wellers.
