Applications in Duke of Sussex v NGN

Mr Justice Fancourt will hear two applications today in Duke of Sussex v NGN. The Duke of Sussex’s claim, against the publisher of the News of the World and The Sun, is for misuse of his private information arising from unlawful information gathering. The claim is part of the wider Mobile Telephone Voicemail Interception Litigation.

The Duke of Sussex’s application is to amend his case to assert that NGN should be estopped from raising any limitation defence.  NGN previously applied for summary judgment arguing the claim was time barred. This will be determined alongside the amendment application.
