Summary Judgment granted in IPL cricket case

On 16th July 2026, Mr Justice Griffiths handed down a reserved judgment granting summary judgment on contractual claims arising out of a Settlement Agreement entered into by the Claimants, an individual and company concerned in the ownership of the Rajasthan Royals, an Indian Premier League team, and a former corporate shareholder and its director, Raj Kundra.

The High Court granted summary judgment on all the principal contractual claims, ordered repayment of the US$4.9m settlement sum, confirmed the validity of the relevant agreements and share transfers, and granted permanent injunctions to enforce the defendants’ contractual obligations. It also granted a permanent anti-suit injunction restraining the defendants from pursuing proceedings before the Indian courts. A series of declarations were also made, including that defendants had no continuing interest or rights in the Rajasthan Royals franchise.

The Court found there was no evidence to support allegations of fraud, misrepresentation or breach of fiduciary duty advanced against the Claimants and no basis to challenge the lawfulness of the Settlement Agreement, having regard to the Court of Appeal’s decision in Mionis v Democratic Press SA [2018] QB 662.

5RB‘s Adam Speker KC acted for the Claimants, leading Emma Horner and Nicholas Wright of 4 Stone Buildings instructed by Alastair Shaw of Level Law.

On earlier applications in the proceedings for an interim injunction and on a return date, Adam Speker KC led Ben Hamer. Andrew Hunter KC of Blackstone Chambers was also involved at earlier stages of the litigation.

The judgment is available here.
