Urgent Injunctions

5RB‘s barristers are available to advise in urgent injunction applications, including outside of normal working hours. Our members have particular experience in relation to emergency interim privacy and confidence injunctions and in cases involving harassment and blackmail, including against persons unknown following cyber-attacks. In all of the instances, time is of the essence, and our members are experienced in acting swiftly and decisively.

We do not deal with emergency injunctions in areas of law that lie outside our specialism in media and communications law, such as those relating to immigration matters, landlord and tenant and land law cases, such as evictions or removals of those with no right to be on land.

We have members of chambers available to deal with emergency applications during evenings and weekends. It is advisable to call us by Friday in relation to any likely or foreseeable weekend injunctions, particularly if you are hoping to be advised by a specific barrister. Should your chosen barrister not be available, we will provide alternative options.

The barrister instructed will be able to advise you how to contact the court, set up a hearing with the duty judge and the relevant documents that will be needed. The most pressing matter is the evidence. You should ensure, so far as possible, that detailed instructions are taken from the client and a draft witness statement is prepared.

If the court grants the order sought, the respondent will be prohibited from doing what is identified in the order until the ‘return hearing’ – a subsequent hearing on notice to the respondent to determine whether the injunction should be granted on a permanent basis.

The respondent will not be prohibited from doing what the order was intended to prevent. In such instances, and depending on the circumstances, the applicant may then wish to bring a claim for damages and a permanent injunction, or appeal the decision.
